A city that doubled after 1980

Oak Creek's housing stock roughly doubled in twenty years: the Encyclopedia of Milwaukee counts 5,706 housing units in 1980 and 11,897 in 2000. The Census median year built is 1991, and only 3.3% of units predate 1940. Growth has not stopped; the state's 2026 population estimate is 39,218, up from 36,497 at the 2020 Census.

That age profile changes the questions. Most Oak Creek houses were started after June 1, 1980, which puts them under the Wisconsin Uniform Dwelling Code. Under SPS 320.04(2), alterations to a code-covered home must meet the code in force when the permit is applied for, or when the project begins if no permit is required. So a re-roof that needs no City permit still has to meet the state's roofing rules, including ice-dam protection on slopes of 4:12 or less over heated space, 30 in. up from the roof edge and 12 in. past the inside face of the wall.

The work itself tends to be about age, not history. A house built in 1991 is 35 years old in 2026. InterNACHI's life-expectancy chart, which it calls a guideline only, puts three-tab shingles at about 20 years and architectural shingles at about 30, so a boom-era house still on its first roof is at or past that point, and its siding, gutters and bathrooms are the same age. The older third of the stock, 35.9% built before 1980, still needs the lead-safe conversation for pre-1978 homes. And 42.5% of occupied homes are rented, so decisions about exterior work often rest with a landlord rather than the people living there.

Oak Creek needs no permit for a shingle tear-off and replacement, but it does for “any re-decking, structural change, or alteration to the roof line.” Rotten sheathing is often found only once the old roof is off, so an estimate should say how damaged decking will be handled and that it triggers a permit. Gutters for lake-effect snow

Snow totals near the lake can differ sharply from inland ones; in a February 2021 lake-effect event, the National Weather Service measured 10 to 16 in. along the lakeshore against 1 to 4 in. inland. More snow means more meltwater, which makes gutter size, pitch and downspout discharge matter more; University of Minnesota Extension advises discharging at least 4 ft from the wall. See gutters.

Oak Creek requires a building permit “for any renovation or remodel done to an existing residence,” and on a code-covered home the bath must have an exhaust fan of 50 cfm intermittent or 20 cfm continuous, ducted outdoors. Re-siding needs a City permit only if framing changes. The part that matters is underneath: vinyl is a cladding, not a water barrier, and the Vinyl Siding Institute requires it over a water-resistive barrier, hung loose enough to move. See siding.

Oak Creek permits: structure is the trigger

The City's residential alteration guidance is specific. “A permit is not required for a shingle tear-off and replacement,” and an overlay is exempt only if the roof will not exceed two layers. Siding and windows need a permit “only if structural or framing changes” are involved. Any renovation or remodel of an existing residence needs a building permit, though replacing a countertop does not.

On the Lake Michigan shore

Oak Creek has Lake Michigan frontage, and the Wisconsin Coastal Resilience project, run with Wisconsin Sea Grant, lists it among communities whose “bluffs, beaches and harbor infrastructure” face erosion, coastal storms and changing water levels. Two older place names, Carrollville and Oakwood, sit inside the city; homes there get their permits from the City of Oak Creek.

Do I need a permit to replace my roof in Oak Creek?

Not for a shingle tear-off and replacement. You do need one for any re-decking, structural change or change to the roof line, and an overlay is allowed without a permit only if the roof stays at two layers or fewer.

If no permit is needed, does the building code still apply?

For homes started on or after June 1, 1980, yes. The state code says alterations must comply at the start of the project when no permit is required. Most Oak Creek homes fall in that group.

Why do my gutters overflow with ice every winter?
